Sell a Car With a Lien

A loan or recorded lien needs to be addressed before a junk-car sale can be completed. Start with the lienholder's payoff and release instructions, then confirm whether the buyer can complete the transaction under those conditions. A damaged or non-running car does not make the debt disappear.

You can ask about an as-is vehicle offer, but disclose the lien before accepting or arranging pickup. Do not assume the buyer offers loan-payoff services.

Identify which lien situation applies

You still owe money on an auto loan

Contact the lender for a current payoff amount, its valid-through date and the process for releasing the title or recorded lien. Ask how an intended sale must be handled. The monthly statement balance may not be the amount needed to close the loan on the sale date.

The loan is paid, but the title still lists the lender

Locate the lender's release and check the state's transfer instructions. A paid loan and an updated title record are separate steps; do not tell a buyer the paperwork is clear until you can document the release.

The claim is for towing, storage or repairs

Ask the party claiming the lien and the relevant agency what applies. Do not use ordinary auto-loan instructions as a substitute for resolving a repair-shop or storage dispute. If the claim or your right to sell is disputed, obtain appropriate legal guidance before transferring the vehicle.

Match the offer to the payoff arrangement

Keep the buyer's vehicle offer separate from the lender's payoff amount. If the offer is lower, ask the lender how the difference must be handled. Selling the car does not automatically cancel any remaining balance.

Chase's guide to selling a car with a lien recommends checking the lien and contacting the lender for the payoff. Your own lender's instructions and the actual buyer's capabilities determine the transaction you can complete.

  • Obtain the payoff and release procedure directly from the lender.

  • Tell the buyer the lien status and ask whether it can participate in that process.

  • Confirm who pays which amount, to whom, and through which verified channel.

  • Confirm when the title or release will become available.

  • Agree on when ownership and possession can transfer after the required conditions are met.

Do not hand over the car based only on a promise that someone will deal with the lender later. Keep the lender's instructions and written sale terms together.

What a lien release may look like

New York DMV explains that an owner who has satisfied a lien can transfer a New York title with the original signed lien release attached; obtaining a replacement clear title first is not always required there. What if the car is totaled or does not run?

Describe its current condition accurately when asking for offers. The lien process and physical pickup requirements both need attention. A buyer may need special loading arrangements even after the ownership documents are ready.

Common lien questions

Can I junk the car and keep paying the loan?

Do not assume your loan allows that. Ask the lienholder about its rights and the conditions for disposing of the vehicle before agreeing to scrap or transfer it.

Does a bill of sale remove a lien?

Do not treat it as a lender release. Confirm the required release and transfer documents with the lienholder and state agency.

Do not assume loan-payoff handling is included. Disclose the lien when requesting an offer and confirm what the actual buyer can do before making plans.
